General Terms and Conditions Mom in Balance subscription

- You start out with either a Pregnant or Back in Shape subscription for a minimum of 3 months. If you would like to participate in the Pregnant workouts but you are already quite far in your pregnancy, please contact linz@mominbalance.at. to make an arrangement that suits your pregnancy. The Mpower subscription runs for a minimum of 1 month.

- Registration takes place by fully completing the registration form on the website and sending it in. The membership starts on the date of commencement as stated on the registration form.

- By registering the participant declares to accept the General Terms and Conditions of Mom in Balance.

- The Pregnant subscription ends automatically on the due date. If the delivery has taken place before the due date, then the subscription will be ended on the date of delivery. Send an email to linz@mominbalance.at if this occurs.
If you would like to convert your Pregnant subscription into a Back in Shape subscription send an e-mail (at least 1 month in advance) to linz@mominbalance.at.

- You can always change your subscription from training once a week to training unlimited. Changing from unlimited to once a week can be arranged up to a month in advance, as per the 1st of the month. Send an e-mail to linz@mominbalance.at.

- You can temporarily or definitely stop your subscription when you are unable to train due to injuries or illness. This should be reported immediately via linz@mominbalance.at. Your subscription is paused from the day of notification.
In case you are pregnant you can change your Mpower subscription into a Pregnant subscription (notify us one month in advance).

Membership , term and payment conditions

- Dues must be paid after receiving the invoice via e-mail. The payment should be done by bank transfer unless different agreements have been made via linz@mominbalance.at.

- If you fail to pay us the fees by the due date, we are entitled to refuse you participating in the workouts. If unpaid fees remain outstanding, and after attempts by us to rectify the arrears your membership may be forwarded to a collection agency for further action. Any associated costs will be recovered on you.

- Mom in Balance is entitled to end the subscription in case of remaining unpaid fees. Payment is still required.

- Mom in Balance reserves the right to change the fees as they see fit. You will be notified at least 3 months before a price change. The price change will not apply to the current duration of the contract.

- The subscription is personal and not transferable.

 
Workouts

- Mom in Balance reserves the right to change training hours, location, programs etc.

- Despite of the weather, the workouts will always take place. Only under extreme weather conditions or because of illness of the trainer, the workout can be cancelled. You will always get a possibility to catch up at a different time in that same week. Cancellation of the workout will be communicated (by mail) not later than one hour before the start of the workout.

- The workouts always take place with exeption of the following public holidays: Ephiphany (6th January), Easter, National Holiday (1st May), Himmelfahrt, Whit Monday, Corpus Christi, National Holiday (26th October), All Saint’s Day (1st November), Immaculate Conception (8th December), Christmas (25. und 26. Dezember), Silvester (31. Dezember) and New Year’s Day (1st January).
If workouts needs to be cancelled because of official public holidays, there is no claim of reducement of the monthly fee.

- Mom in Balance can not be held responsible for any lost items.

- If you choose not to take part in the workouts Mom in Balance is offering, no refund will be made. Nor will this be added to your new period. It is always possible to catch up the missed workouts on other days. Always within the period of 3 months. The right to catch up missed workouts expires after ending the membership. Missed workouts can not be added to your current period as extra weeks of that period. 

- You can not -temporarily- stop the subscription due to holidays, except for the special arrangements during the Summer period. It is possible to catch up the missed workouts on other days. Always within the period of 3 months, The right to catch up missed workouts expires after ending the membership.

- During the summer period (July until mid-September) you could pause your membership if you are away on holiday. Your pause should always be announced 1 month upfront via e-mail (linz@mominbalance.at) and is always with a maximum of 3 weeks. If you decide to stop the membership over the holiday break there is also the regular one month notice period.

- Participation is at your own risk. During the workouts you will listen to your own body, and follow the trainers’ instructions.

 
Ending the subscription

- You can temporarily or definitely stop your subscription when you are unable to train due to injuries or illness. This should be reported immediately via linz@mominbalance.at. Your subscription is paused from the day of notification.

- The Pregnant subscription can be ended after your first membership period (three months), with an one month notice period via linz@mominbalance.at. Without a termination the Pregnant subscription will be extended automatically until the maximum of your due date.

- The Back in Shape subscription can be ended after your first membership period (three months), with an one month notice period via linz@mominbalance.at.


- The Mpower subscription has a notice of 1 month.
